Personal Data Protection Policy

This Personal Data Protection Notice is issued to all our valued students / prospective students, pursuant to the requirements of the Personal Data Protection Act 2010. We treat and view your personal data seriously. In the course of your dealings with Equator Academy of Art & Design Sdn. Bhd. as our valued students / prospective students, we will request that you provide data and information about yourself (Personal Data) to enable us to enter into a transaction with you or to deliver the necessary notices and services.

Such Personal Data may be subject to applicable data protection, privacy and other similar laws and may include information concerning name, age, identity card number, passport number, address, gender, date of birth, marital status, education qualification, contact information, email address, race, ethnic origin, nationality and medical information.

The failure to supply such Personal Data will:-

1. results in us being unable to provide you with the notices and services as requested;
2. result in us being unable to update you on our latest education updates and services.

The Personal Data is collected, used and otherwise processed by us for, amongst others, the following purposes:

1. delivering notices, services, billings and education updates to you;
2. maintaining and improving student relationship;
3. maintaining and updating internal record keeping; and
4. meeting any legal or regulatory requirements and making disclosure under the requirements of any applicable law, regulation, terms and conditions, direction, court order, by-law, guideline, circular, code applicable to Equator College.

The Personal Data provided to us will generally be kept confidential but you hereby consent and authorize us to provide or disclose your Personal Data to the following categories:-

1. any person to whom we are compelled or required to do so under the law ;
2. statutory authorities, government agencies and education regulators;
3. our consultants, accountants, auditors, lawyers or other financial or professional advisers; and
4. our service providers for the purpose of establishing and maintaining a common database where we have a legitimate common interest.

We shall keep and process your personal data in a secure manner. We endeavour, where practicable, to implement the appropriate administrative and security safeguards and procedures in accordance with the applicable laws and regulations to prevent the unauthorized or unlawful processing of the Personal Data and the accidental loss or destruction of, or damage to, the Personal Data.

You have the right to request for access to and correction of your information held by us and in this respect, you may:

3. Request that your Personal Data is retained by us only as long as necessary for the fulfilment of the purposes for which it was collected;
4. Request that we specify or explain our policies and procedures in relation to the data and the types of Personal Data handled by us;

6. Withdraw, in full or in part, your consent given previously, in each case subject to any applicable legal restrictions, contractual conditions and a reasonable time period.

Your personal information may be disclosed due to reasons of law, legal process, litigation, and/or requests from public and governmental authorities and any disclosure will be to such public and governmental authorities only. We may also disclose information about you if we determine that disclosure is necessary or appropriate for purposes of national security, law enforcement, or other issues of public importance.

Your application, registration, and enrollment indicates your consent to the use of your Personal Data in accordance with this Personal Data Protection Notice. We may review and update this policy from time to time to reflect changes in the law, changes in our college practices, procedures and structure.

Equator College hereinafter wants you to be familiar and understand how we use and protect the information obtained. This Privacy Policy describes our practices in connection with the information collected from those visiting / using Equator’s website https://www.equator.edu.my operated by us (the “Websites”) through the applications made available by us through our social media pages (our “Social Media Pages”). By using the Website, you consent to the collection/retention and use of your personal information in accordance with this policy.

We and our service providers collect Personal Information in a variety of ways, including:

We collect Personal Information through the Services, for example, when you visit one of our sites, apply for admission, or maintain an ongoing relationship with us as a student. Data information will be collected from you during your course of study or period of enrollment with us. We collect Personal Information from you offline, such as when you complete an application for admission, fill out a form at an education or career fair, apply for a student ID card, participate in a promotion, or contact our office and branch. Equator College needs to process (that is, collect, use, store and ultimately destroy) your personal data for various academic, educational and administrative purposes. Generally, your personal data that we collect and process, includes but not restricted to: Name, Identification number (NRIC), Passport number, Address, Contact numbers, Gender, Date of birth, Previous qualification, Personal email address, Photo and images, Marital status, Emergencies contact person(s) details, Family / guardian information, bank details.

Some of the personal data that we process may include what is defined as ‘sensitive personal data’ under the Act and these include, but not restricted to: Race, Religion, Health, Records of misconduct and disciplinary action, Records of criminal offence. This sensitive information shall be treated carefully by Equator and will only be used for specific purposes. It will not be released to a third party without your explicit consent unless it is necessary to protect your interests.

The provision of all information requested for in the relevant forms of Equator College is mandatory, unless specified otherwise. This is to enable us to process your application and / or request for our services. Should you fail to provide the said information, Equator will be unable to process your request and / or provide you with the relevant services.

Where we have given you (or where you have chosen) a password which enables you to access certain parts of the Website, you are responsible for keeping this password confidential. We ask you not to share a password with anyone. We will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to the Website; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorized access.

Authorized personnel within Equator College will be able to access the information you provide to us.
